Judge dismisses charges against three NM compound suspects TAOS COUNTY, N.M. - TAOS COUNTY, N.M. - A judge has dropped the charges against three of the five suspects who were arrested at a compound in northern New Mexico. District Judge Emilio Chavez made the decision just after noon Wednesday in regards to Lucas Morten, Hujrah Wahhaj, and Subhannah Wahhaj saying the prosecution failed to indict them within ten days of their first appearance in court.
Judge Chavez noted that the state can re-file charges based on new information at a later date. The suspects were taken into custody during a raid of the compound near Taos in early August and had faced child abuse charges in regards to the 11 children who were found at the compound in dire conditions.
Earlier this month, Judge Sarah Backus denied a motion to detain the five adults saying the state failed to meet the burden of proof showing the suspects were a danger to the community, but the state appealed.
First appearances are also expected to be held today for Siraj Wahhaj and Jany Leveille on newly filed charges of first-degree child abuse resulting in death and second-degree felony conspiracy to commit child abuse. Wahhaj is accused of abducting his son Abdul Ghani Wahhaj from Georgia. The 3-year-old boy's remains were found at the compound days after the raid.
