Insanity Rules! Maine: Court Orders That Boy Must Be Allowed To Use Girl's Bathroom - UPDATED AND BUMPED: Father, Wayne Maines, Is An Activist and Huffington Post Contributor

From Maine's Portland Press Herald:
Maine’s highest court: Transgender student’s rights were violated

Nicole Maines’ school was wrong to require the fifth-grader to use a unisex bathroom, justices rule in a historic gender-identity decision that could be a model for other states.

The rights of a transgender girl from Orono were violated when school administrators made her use a staff bathroom at her elementary school instead of the girls’ restroom, the Maine Supreme Judicial Court ruled Thursday.

The ruling is the first in which a state supreme court has affirmed a transgender person’s right to equal access to restrooms in places of public accommodation.

Lawyers representing Nicole Maines, who is now 16, said the decision could lay a foundation for other states’ courts that are facing questions about the emerging rights of people who identify as the opposite of their birth gender....
Read the rest HERE. You have to read it to believe that this is the sorry condition into which America has descended by leaps and bounds.

BTW, the court's ruling was 5-1. The decision wasn't even close.

UPDATE, FROM PASTORIUS -

Nicole's father, Wayne Maines, is a Transgender Activist and Huffington Post contributor.

I'm guessing there will be a lot more to dig up on this guy.

UPDATE - Wayne  Maines has a Phd. from West Virginia University

I want to find out what field his Phd. is in.

IF ANYONE KNOWS HOW TO GET A HOLD OF HIS THESIS, PLEASE HELP.

UPDATE - In this video, Wayne Maines claimes, with a smirk, that he is "a former Republican."

UPDATE - Here, Maines claims he was "a Ronald Reagan Conservative," and that he is still a Conservative.

If that's the case, then why does he smirk in the above video?

UPDATE - I think this is his Doctoral Thesis, published in book form.

  1. This school in Orono is right nearby and we are very friendly with several teachers. One is Mrs. Epa's closest friend

School went WAY WAY out of it's way to satisfy the child's and her/his parent's requests (then demands).

Because the child was GRANTED the right to use the private teacher's lounge bathroom, this should have been solved RIGHT THEN. In fact other students and parents complained about this child going into any bathroom, which drove the school's attempt to find some solution which might be acceptable to all.

Orono is a tiny town about 8 miles north of Bangor and frankly a small town, small school solution SHOULD HAVE SUFFICED for this exceptional one off situation.

Instead this CAMPAIGN resulted by offending everyone after major efforts to satisfy were made, in the family MOVING and leaving the area entirely.

We have watched this develop for YEARS from the inside.

All parties in the school did NOTHING but try to find a way to satisfy all the desires and objections. Anything else reported is a distortion.

If someone can explain why using the teacher's lounge private bathroom was unacceptable when so many other parents and students felt compromised and THEIR values demeaned, I sure would like to hear it.

    Everyone loses.

  2. Epa,
I'm so glad you commented! I was hoping that you would know more details. And you do!

  3. Epa,
Do you happen to know that this transgender individual is doing for gym? In the showers, I mean.

  4. You will probably laugh at my stupidity, but I am still confused about how it is possible for a 5th grade student to have transgender issues. And of course, I am wondering why its parents aren't taken out into the woods ...

Do you realize that somewhere in America there is another 5th grade student, who knows what sex they are, who will one day end up with the transgender and begin a life of pure hell?

  5. To me, and knowing what went on ... incidents like this are utterly individualized and rare. I hate to see this made into the CASE for what to do, and not some incredibly exceptional thing.

  6. Did this kid's family have some lawyer or organization behind it?

Did the family live in the area for a long time, or had they just moved in?

I don't believe this Transgender issue is so much about tolerance and accommodation at it is about an effort by the left to break down all boundaries and hierarchies, including the distinction between man and woman.

That is not to say I don't believe there are individuals whose sexuality is physically and mentally confused. And it does not mean I believe that such people ought to be treated with love and respect. However, they are no more the norm than Developmentally Disabled people are the norm. We can not create a society around catering to Developmentally Disabled people, and we can't create a society around catering to Transgendered.

  7. The report isn't clear on the child's reason for 'transgender' designation. There are some cases where a birth results with ambiguous gender identity - hermaphrodite - and the family/medical team either assign a gender for the birth certificate or in extreme cases, surgically define the gender post birth. Could this be one of those ambiguous cases in which the child was assigned a 'male' gender designation at birth?

  8. Yes, it could be. But how does that impact what we are discussing here?

  9. There but for the grace of God, go I.

If a child of mine was born with ambiguous gender identity requiring surgery sometime after birth, I would hope the child would demonstrate clear leanings to one gender identity or the other.

The linked report reveals only the following about her backstory:

"...the case stems from an incident that occurred when she was in fourth grade, Nicole Maines – born Wyatt Maines – had identified as a girl since as early as age 2."

Was this gender identity crisis one of nurture or nature?
I reveal a clear personal bias & express great sympathy and compassion for a family dealing with genetic anomolies.

On the other hand, I can muster little to NONE for the agenda-driven/nurtured/engineered nonsense within the transgender mutation psych ward.

NECN video report doesn't add much in clarification, but illustrates that this child sounds and appears like a normal female now.

Perhaps EPA can clarify whether this was an agenda driven court case for the LGBT movement or was it triggered by some hurtful incident by someone who unnecessarily revealed her medical background as mentioned in the linked story. . .

"When a grandparent of a boy student complained, the school changed its position and made Nicole use a staff bathroom."

The only additional hints we have to her backstory provided thus far are:
" She moved to Southern Maine with her family several years ago. "
    and
"Her family sued the school in 2009 with the help of the Maine Human Rights Commission."

Assuming she was born with medically identified gender ambiguity, did her family's move to this district take place in order to protect/secure her gender identity, only to have her medical history breached?

Or were her parents of the new-age 'genderless' dogma responsible for nurturing this gender assignment?

  10. An added thought . . .my instinct leans towards birth anomaly in this case because the child is identified as 'transgendered' which to me indicates surgically altered.

I find it difficult to believe there are medical professionals in this country that would reassign/alter a young child's gender for psychological/non-medical reasons. In the very least, I would think the psychological treatment prior to gender reassignment would take as long as - if not longer - than the length of time it took to get this decision after appeal.

I admit that the social acceptance of such needless surgery is changing, but I would hope that the social climate hasn't changed that significantly yet.

  11. It seems to me that whatever external genitalia is there should determine which bathroom facilities an individual uses.

  12. via dictionary.com trans·gen·der/trænsˈdʒɛndər, trænz‐/ noun
    1. a person appearing or attempting to be a member of the opposite sex, as a transsexual or habitual cross-dresser.
Every adult who enabled this bastardized behavior should be held to account as well. Where the hell is CPS?
    Origin: 1990-95

    *****
    World English Dictionary:
-adj. of or relating to a person who wants to belong to the opposite sex.

    ------------------------
based on the above definition of the term "transgendered", it appears the child's gender assignment is psychological.

    Ugh.

In that case, I have to agree with the above -- the child should be forced to use the lavatory designed for the anatomical gift he was bestowed at birth, rather than the psychologically preference.
