(Lafayette Hill, Pennsylvania – 10/21/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that Obama and tbe DNC “ADMITTED”, by way of failure to timely respond to Requests for Admissions, all of the numerous specific requests in the Federal lawsuit. Obama is “NOT QUALIFIED” to be President and therefore Obama must immediately withdraw his candidacy for President and the DNC shall substitute a qualified candidate. The case is Berg v. Obama, No. 08-cv-04083.
Berg stated that he filed Requests for Admissions on September 15, 2008 with a response by way of answer or objection had to be served within thirty [30] days. No response to the Requests for Admissions was served by way of response or objection. Thus, all of the Admissions directed to Obama and the DNC are deemed “ADMITTED.” Therefore, Obama must immediately withdraw his candidacy for President.

You might note that at the beginning of the post I pointed out the question which remains.
We have always offered up all sorts of news here, and if it is questionable, we try to highlight the questions.
We did that here, as we endeavor to do on a consistent basis.
I think your comment is unfair. I wish you'd explain yourself.
You seem to be agreeing with/promoting the claim. That may not be what you meant and I may have been hasty in reading it that way. If you would have had a question mark on the end of "The Court takes the lack of response as an admission of guilt." instead of a period, it might have been more clear. A lack of response is not an admission.
A Request for Admissions is a pre-trial device to introduce evidence into the record. If unresponded or unrefuted, it becomes part of the record just as if it had been introduced as evidence at trial. Even if they don't refute it pre-trial, the other party can refute it at trial. You can't use it to force the court's hand; the judge or jury is free to consider the credibility of the claim as with any trial witness. In this case there will probably never be a trial and thus no ruling. This is nothing but a trick.
Do you know who Berg is? He's a former Democrat county commissioner and Hillary backer who is bitter about the primary. He is also a "truther". He filed a RICO lawsuit against the Federal government claiming foreknowledge of the 9/11 attacks and a conspiracy to subvert the Constitution. He also claims that Jeb Bush sent the records of the Hoffman Aviation School out of the country on an Airforce jet. He's the kind of person the Daily Kos links.

The Republican Party is just a bunch of white racists. It is filled with a bunch of Angry White Guys (and Gals) who think the 1965 Hart-Celler Immigration Act ruined America because it made it a lot harder for whites from Ireland, England, France, Germany, Italy, etc. to immigrate to the U.S. and made it a lot easier for the Chinese, Indians, Jamaicans, Mexicans, Egyptians, etc. to immigrate to the U.S. What these racists don't GET is that the 1965 Hart-Celler Immigration Act (Thank You Senator Ted Kennedy) greatly increased Diversity in the U.S. which has made OUR Nation stronger and a much more multicultural place to live. Before 1965 Whites of European descent made up 88% of the U.S. population. Now whites only make up 65% of the U.S. population and by 2042 they will only make up 49% of the population. By 2100 Whites of European descent will only make up about 30% of the U.S. population and also by the year 2100 only 3% of the World Population will be White. The 2008 Election is just a turning point in American History though. By the end of this century white Europeans will be out of power (FINALLY!). The World is Flat. The white racist Republicans just don't seem to get it!
