AFL-CIO Attorney: “It is legally impossible to conduct a nationwide raffle”

We recently sent a complaint to the Federal Election Commission with regard to the “Dinner with Barack” fundraising promotions of 2007 and 2008. The Center for Competitive Politics quoted AFSCME (part of AFL-CIO) associate general counsel Jessica Robinson on the use of raffles to raise money for political campaigns.

Ms. Robinson says unequivocally that it is impossible to legally conduct a nationwide raffle and furthermore that doing so violates the Federal Racketeer Influenced and Corrupt Organization (RICO) statute. Racketeering includes systematic violations of any state’s gambling laws.. This means there is excellent cause to remove Barack Obama from office without an extensive foray into the Twilight Zone to find his birth certificate. If Obama for America broke the law by running an illegal Internet gambling operation, and Minnesota law enforcement is on record as saying that it did, that is cause for impeachment. Not that I expect anything will come from trying to hold Obama to the letter of the law. Those who support Obama will just brush off any violation of the law that he perpetrates.

From The Birmingham News, March 22, 2009: Volunteers fanned out across the Birmingham area and Alabama Saturday to pump up enthusiasm for President Barack Obama's budget proposal in much the same way they did to win over voters during the presidential campaign.
About 30 volunteers in Birmingham canvassed shopping areas and other high-traffic locations to talk about the need for health care reform, an education overhaul and environmentally friendly energy development.

"If we don't change these three things in the next 10 to 15 years, America is over as we know it," Chris DeHaven, told the group of volunteers before they went their separate ways.

Obama's plan faces criticism from Republicans and others who say it's too expensive. The nonpartisan Congressional Budget Office released a report Friday saying Obama's agenda would cause huge budget deficits, forcing the country to borrow $9.3 trillion in the next decade.

Those who gathered at Kelly Ingram Park in downtown Birmingham were urged to enlist others who share Obama's vision and to stay away from trying to convert naysayers.

"We're looking for supporters," said DeHaven of Hoover, one of the event's organizers. "We're not looking for a fight. That will come later, when we have an army."

The volunteers are part of Organizing for America, the same grassroots, national network credited in large part with Obama's quick rise from obscurity to president. Birmingham and 11 other sites statewide were part of a national push this weekend by Organizing for America to trumpet Obama's spending proposal.

The meaning of DeHaven's remarks should not be mistaken: They are not interested in winning supporters through rational discussion. This campaign is aimed at organizing existing supports into an "army" for "a fight" against "naysayers" once that army has been created.

Of course, one could take it to mean that the "fight" will be merely a war of words. Which is why they need an "army"...

The press release states:

Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States today filed with the U.S. Supreme Court an Application for an Injunction to Stay the Electoral Votes on December 15, 2008 and prohibit V.P. Richard B. Cheney, the House of Representatives and the Senate counting any votes for Obama until Obama Proves he is “Qualified” to be President. (...)

Mr. Berg remarked today, “I know that Mr. Obama is not a constitutionallyqualified

Berg continued, “Obama knows he is not ‘natural born’ as he knows where he was born and he knows he was adopted in Indonesia; Obama is an attorney, Harvard Law grad who taught Constitutional law; Obama knows his candidacy is the largest ‘hoax’ attempted on the citizens of the United States in over 200 years; Obama places our Constitution in a ‘crisis’ situation; and Obama is in a situation where he can be blackmailed by leaders around the world who know Obama is not qualified.” (...)"

89 Percent of Muslim Voters Picked Obama

Ninety-five percent of respondents said they voted in the presidential election, whether at the polls or by absentee ballot. This is the highest American Muslim voter turnout ever reported.

Of those who voted, almost 14 percent said they did so for the first time.

One-fourth of respondents said they volunteered for or donated money to a political campaign in this election.

American Muslim voters are increasingly identifying themselves with the Democratic Party. More than two-thirds said they consider themselves Democrats. Most of the rest, or 29 percent, still consider themselves independent. Only four percent said they are Republicans.

The Morning After

In an article in the Wall Street Journal, Fouad Mjami had this to say:

The day after, the crowd will of course discover its own fissures. The affluent will have to pay for the programs promised the poor. The redistribution agenda that runs through Mr. Obama's vision is anathema to the Silicon Valley entrepreneurs and the hedge-fund managers now smitten with him. Their ethos is one of competition and the justice of the rewards that come with risk and effort. All this is shelved, as the devotees sustain the candidacy of a man whose public career has been a steady advocacy of reining in the market and organizing those who believe in entitlement and redistribution.

The morning after the election, the disappointment will begin to settle upon the Obama crowd. Defeat — by now unthinkable to the devotees — will bring heartbreak. Victory will steadily deliver the sobering verdict that our troubles won't be solved by a leader's magic.

Blogging During An Election Year

I began blogging in mid-2005, so this year is my first in the blogosphere during the run-up days to a National Election. What a frenzy! It's all about the election, all the time — or nearly so. Perhaps all general elections cause such turmoil on the web and elsewhere, and I simply didn't notice.

Last week, a friend of mine in Moline, Illinois, phoned. He wanted to share with me some of the not-so-well-covered information on Barack Obama. This friend of mine — I'll call him Bill — doesn’t use the web at all. Instead, he relies on the mainstream media and word of mouth as his sources. Not unexpectedly, Bill didn’t have any information I didn’t already know. In contrast, because I surf the web every single day, I had some information he had never heard....

Obama's New Attack on Those Who Don't Want Higher Taxes: 'Selfishness'

On the stump this week, Sen. Barack Obama, D-Ill., has pushed back against Sen. John McCain's description of his tax policies.

"The reason that we want to do this, change our tax code, is not because I have anything against the rich," Obama said in Sarasota, Fla., yesterday. "I love rich people! I want all of you to be rich. Go for it. That's the American dream, that's the American way, that's terrific.

"The point is, though, that -- and it's not just charity, it's not just that I want to help the middle class and working people who are trying to get in the middle class -- it's that when we actually make sure that everybody's got a shot - when young people can all go to college, when everybody's got decent health care, when everybody's got a little more money at the end of the month - then guess what? Everybody starts spending that money, they decide maybe I can afford a new car, maybe I can afford a computer for my child. They can buy the products and services that businesses are selling and everybody is better off.

The best way to help people into the middle class and above is to identify those who will work for it, those who have the need for and want more education, AND THEIR CHILDREN, and then to give them the path to achieve that end.

Giving people a check does NOT make poor people middle class.

Giving them a way to go from technician to MSEE WILL ABSOLUTELY.

With every word, with every further justification and explanation, Sen Obama is explaining very accurately who he is and what he believes.

He doesn't want to take our dreams in order to protect the nation from enemies foreign and domestic, he wants to take our dreams for ourselves and our children in order to DIMINISH them for a check to others ...who will never achieve theirs that way.

He really believes that to hold to the American dream for yourself and your children, IS SELFISHNESS.

Berg's Lawsuit Dismissed

I don't know that I quibble with Berg's lacking standing. That may indeed be so.

But Obama's Constitutional qualifications don't matter? Is that what the judge is saying? If so, then this also follows:

Obama 'admits' Kenyan birth?

Pennsylvania Democrat Philip J. Berg, who filed a lawsuit demanding Sen. Barack Obama present proof of his American citizenship, now says that by failing to respond Obama has legally "admitted" to the lawsuit's accusations, including the charge that the Democratic candidate was born in Mombosa, Kenya.

As WND reported, Berg filed suit in U.S. District Court in August, alleging Obama is not a natural-born citizen and is thus ineligible to serve as president of the United States. Though Obama has posted an image of a Hawaii birth certificate online, Berg demands that the court verify the original document, which the Obama campaign has not provided.

Now Berg cites Rule 36 of the Federal Rules of Civil Procedure, which states that unless the accused party provides written answer or objection to charges within 30 days, the accused legally admits the matter.

Since Obama has only filed motions to dismiss and has not actually answered the charges in the lawsuit, Berg claims, according to Rule 36, Obama has legally admitted he is not a natural-born citizen.

Now Berg is asking the court for a formal declaration of Obama's admission and asking the Democratic National Committee for another presidential candidate.

In a statement released today, Berg argues that he filed Requests for Admissions on Sept. 15, meaning Obama had until Oct. 15 to answer or face the consequences of Rule 36.

"Obama and the DNC 'admitted,' by way of failure to timely respond to Requests for Admissions, all of the numerous specific requests in the Federal lawsuit," Berg's statement reads. "Obama is 'not qualified' to be president and therefore Obama must immediately withdraw his candidacy for president and the DNC shall substitute a qualified candidate."

I have been hoping I would never have to write this article. I hoped it would never get to this point, which would force me to openly speak out against the first African American to seriously have a chance to be elected President of the United States.

But after reviewing all the Stanley Kurtz material on Barack Obama/Bill Ayers relationship, I've come to the conclusion Barack Obama is definitely under the influence of a radical ideology that is so dangerous, it could literally pose a danger to the very existence of the United States, especially when we have an economy already in crises, and a war in progress against one of the greatest threats we have ever faced, in Islamic terrorism.

I know Barack Obama. No I haven't met Barack Obama personally, but I know many African Americans like him. African Americans who were born in the 1950's and early 1960's who are now in their 40 and 50's in age. I am of that generation.

Our generation grew up personally witnessing the turmoil of the 1960's and 70's, which shaped our viewpoint of America. During the great civil rights movement of this era a very young radical element evolved and came into being in the Northern black communities of major cities of America.

This element I refer to did not embrace the nonviolent civil disobedience philosophy of Martin Luther King . . .

Do you really want to put the toxic cocktail of a character mentored and tutored by Rev Jeremiah Wright and Bill Ayers in the White House?

Some African Americans will read this and brand me a traitor for this article. I say to them what good is changing America from what you may believe is bad to something much worse, for the small satisfaction of being able to say we have a black man in the White House.

A Lufkin woman received a surprise visit from the Secret Service last week because of a "death threat" comment she reportedly made about Sen. Barack Obama to a campaign volunteer asking for her support of the presidential candidate.

Two federal agents arrived at Jessica Hughes' home Thursday to ask her if she said, "I will never support Obama and he will wind up dead on a hospital floor."

Hughes said her words were deliberately twisted by a volunteer who was apparently unhappy Hughes was rude during a phone conversation the two had. The Lufkin mother, a Republican, said she received a call on her cell phone Wednesday from a woman with the Obama Volunteers of Texarkana.

"She asked if I was an Obama supporter, to which I replied, 'No, I don't support him. Your guy is a socialist who voted four times in the state Senate to let little babies die in hospital closets; I think you should find something better to do with your time.' (And then) I hung up."

(Hughes is referring to a "born alive" Illinois bill that did not pass in the Illinois state Senate in 2005 and had previously been opposed by Obama because he said it undermined Roe v. Wade, according to FactCheck.org, a non-partisan organization. A federal version of the bill, which Obama said he would have supported, passed by unanimous consent and was signed into law by President George W. Bush in 2002.)

Obama Campaign Communications for Texas director Josh Taylor declined to comment Monday, refusing to answer any questions and referring the matter to the Secret Service, which he said is conducting an investigation. A message left with a Secret Service agent in Houston was not immediately returned.

Hughes said she was surprised to see two Secret Service agents at her door, and upset to learn that the conversation she had with the volunteer apparently had not been recorded.

"I find it hard to believe that (campaign volunteers) don't tape these calls. They call people unsolicited and they aren't monitoring the calls or recording them? I think that is absolutely ridiculous," she said.

"I mean, how often must this happen — that someone is rude to a volunteer that they don't want to talk to?"

Hughes said she wants to file a countercomplaint against the volunteer.

"She has made a charge that will follow me the rest of my life," she said.

"I find that repugnant and violating — that some person got her undies in a bundle because she didn't like what I had to say."

Are all the details in the above correct? I don't know.

Could the details be correct? I think so, and that possibility is most unsettling.

I do know that I'm getting polled a lot these past few weeks. In fact, in the past three days, the New York Times has even called here - twice. And I don't subscribe to the paper, nor am I registered at the newspaper's web site, as far as I recall.

In the past two weeks, I have twice turned away Obama supporters who have knocked on my door.

I have been called by name in each polling episode.

At least once, I have mentioned the Marxism present in the concept of wealth redistribution and have said that Obama advocates such redistribution. I have stated in so many words, "For that reason alone, I cannot vote for Obama."

I don't remember exactly what I've said in each polling episode, but surely my statements have been anti-Obama. Could they be construed in any way to advocate violence? No!

But will somebody - some Obamamaniac - lie or twist my words?

Will the Secret Service show up here at my house?

Call me paranoid, I guess.
