All respect to Antonin Scalia, every bit as much as William O Douglas, Felix Frankfurter, Brandeis, Holmes and a few others whose dissents were as important as their majority opinions.

The president knows he cannot get anyone past the Senate, let alone replace a man who was approved UNANIMOUSLY.

The president began his term of 8 years with a case of clear voter intimidation in Phila, and chose pure division of the people by color rather than keep political appointees away from the investigational / prosecutorial process.

The president again demonstrated his proclivities for division by race and political theory over union of the peoples with the Cambridge professor, the regrettable jackass Zimmerman, Ferguson, Black Lives Matter, Baltimore, etc.

In each of these moments (to say the least) the president chose the divisive and polarizing course over sticking a flag in the ground on the idea of bringing all the people together, and LEADING to that difficult criterion - something ONLY HE was UNIQUELY SITUATED to achieve.

He could have been Reverend King, or Angela Davis

This has nothing to do with legislation. This has to do with what he wants, and I judge that only by what is now history.

Now he has announced he WILL nominate soon, in the face of Majority leader McConnell’s, and Judiciary Committee leader Grassely’s statement that no nominee will be considered for SCOTUS until there is a new president and the PEOPLE have chosen.

Make no mistake, this election will choose what the Supreme Court of the USA will be like. This is a decision which goes far beyond a 4 year presidential term.

The reasons for this nomination, then, can only be political division. Obama knows for a certainty he cannot get anyone approved. He probably realizes he cannot even get it INTO committee properly.
There can be no doubt now, about what Mr. Obama meant by ‘fundamentally transforming’ the USA.
He is certain he is right and this is to the good. DESPITE SEVERAL elections rejecting this idea over and over, state by state, and district by district. The people are misled, you see, by radical right wing tea party republicans.

Or Fox.

Or Rush Limbaugh.

Third grade level excuses.

The president’s acts to polarize the nation have been successful and I am certain this is his purpose because he believes if he forces us to choose, his ideas will prevail in a majority.

This has been done before VERY SUCCESSFULLY as a strategy and tactic.

The party in question which performed these acts had a name which means ‘ONE OF THE MAJORITY’

The quote is Lenin and the party was the Bolsheviks, who by polarizing choices finally founded a majority in 1917.

No matter what happens, Mr. Obama will be recorded one day SOONER THAN ANYONE IMAGINES as far worse than James Buchanan, and few will even mention it was a major thing that he was the first black president. It will become an asterisk.

Sad for us all.

If he does the recess appointment it will lead immediately to a constitutional crisis. Obama will do it. He will hit the accelerator. It is his nature, just like the proverbial scorpion, he can't help himself. Twenty-Sixteen is the year the USA will disappear.

You know, if the Progressives had any patience they could have everything they want within a generation. We'll all be dead. Our grandchildren will be indentured to their student loans, working them off in government jobs. Sixty percent of the population will be dependent on some form of government dole. The 50 states will no longer exist in any potent form.

But these egomaniacs have to have it now. And they don't care how much blood they shed to get it. Pure evil.

Scotus themselves only this past year restricted the president's appointment ability in recess and limited that to when the SENATE declared recess, not the president's interpretation of 'recess'.

Therefore there will be no recess.

And if there is and there is an appointment, that's the end of the republican party.

Why bother voting?

In that case Citizen's United will have insituted an oligarchy of corporations and rich people, and the progessives will be right on that issue, since no one else will be particitpating
