Problematic is that what happened a couple of days ago has nothing to do, really, with what happened a couple of weeks ago. The spitting and kicking? Worthy of perhaps a Class C penalty? No aggressive actions were noted the day he was riddled with bullets. No agent was in danger of losing their life. His hand never touched his weapon. Not once.
