Islam and Rules of Inheritance

Islam and men. Islam and women. 

The polarity between male and female and the traditional roles they are allowed to play within society is clearly annotated within the vast array of jurisprudential writings which span the centuries after the death of Muhammad. 

This fact is important because there is a continuous push to create parallel parliamentary structures within the West. And there are constant incremental legal challenges which are meant to insulate and inoculate Muslims in the West against democratic principles of governance. 

Having been at the periphery of these discussions with a Mufti who graciously invested a decade in my life, I am familiar with the issue at hand. 

What Must not be Allowed in the Western Hemisphere 

So here are a few basics regarding Islam, women, and Islamic laws of inheritance. These facts are taken from a book written by my Mufti colleague. And they derive from a law niche based on the concept of al-Fara-id, or the science of inheritance; in expanded form, “ilm al-Faraidin” which means the science of Islamic shares. 

Everything, and I mean absolutely everything, is pre-determined regarding the share of an estate to which the bloodline is entitled. The word al-Fara’id is the plural form of al-Faridah. 

These laws do not follow under the early social transaction laws of the Makki era, but they are more in line with what are determined to the the “clear proofs” or obligatory acts of devotion toward Allah. 

As a small note, the Hadd penalties (the rights of Allah over man) also fall in this category, so this doctrine is extremely strong as it courses through the veins of Islamic jurists. Beneficiaries of an estate fall into six categories with the heirs who are the primary stake-holders receiving a pre-set share. The flow chart for distribution is not complex. It is simple math based on fractions and bloodline. 

There are multiple legal tributaries involved relating to genealogy. The rulings are set into a template which lawyers are not meant to tamper with, rather to follow to the letter-of-the-law. We must remember that Islam has no precedence for the spirit of the law. 

So when a Muslim widow in the West has in hand a legal will which leaves her the entirety of an estate, and this will is instead adjudicated in an Islamic Tribunal, she will receive: 

“Their (wives) share is a fourth if you leave no child; but if you leave a child, they get an eighth after payment of legacies and debt.” 

Al-Nisa 4:12 Surah al-Nisa is the cap on the “widow’s peak”.

A lot of complexity, ladies and gents. Islam is a legal labyrinth. 

Two short comments. Under Islamic law what is owed an elderly mother is “a dress, a room, and food.” That is sufficient in practical sense and what many children provide for an elderly mom. But what about a nice inheritance which allows a widowed mother to take that dream vacation to Italy? 

Second comment regarding Islam and disparity for women. With Islamic inheritance, there is an Arabic term, “al-Jadd al-Sahih”. What does it mean? It means a real grandfather. 

What does a “real grandfather” mean in Islam? It is the grandchild who is not connected to the deceased through a mother. There is no female between the grandchild and the deceased grandfather.

A taste of sharia

The waitress, a French 30-year-old of Tunisian origin, said she was serving drinks at Monday lunch on the terrace of the Vitis Café on Nice’s rue Lamartine, near the rue d’Anglais, when two men started haranguing her, insulting the young woman because she was serving alcoholic beverages to customers.

A Muslim girl who gets out of line! Time to reacquaint her with the Religion of Peace.

The men launched into a tirade, calling her a “dirty whore” and left the cafe in a hurry. A few seconds later, however, the venue's CCTV footage reportedly shows the two men turn round abruptly and one of them rush towards her and violently slap the waitress in the face, knocking her to the floor.

Today alcohol, tomorrow bacon.

This is a simple truth that many infidels don't understand. For Muslims, sharia is just as valid and moral in Saudi Arabia as it is everywhere else. The evil laws of the Procunt Muhammad do not respect the boundaries of the Middle East or Indonesia or Pakistan or Bangladesh, etc.

So, your choice is simple: submit or fight.

If anyone has the right to make this point, it is our half-African president.

Yet what the president failed to point out is that, around the world, segregation is making a comeback -- including in the streets of Tunis, where the proponents of today's segregation spilled blood last week....

The system of law I am talking about is sharia law, the body of legislation derived from the Qur'an, the Hadith, and the rest of Islamic jurisprudence. And the discriminated group I have in mind is women, though I could also reference Jews, Christians and gays.

No group is more harmed by sharia than Muslim women -- a reflection in part of the patriarchal tribal culture out of which Islamic law emerged. Repeatedly, women are considered under the code to be worth at most "half a man." Sharia subordinates women to men in a multitude of ways: the requirement of guardianship by men, the right of men to beat their wives, the right of men to have unfettered sexual access to their wives, the right of men to practice polygamy, and the restriction of women's legal rights in divorce cases, in estate law, in cases of rape, in court testimony, and in consent to marriage. Sharia states that women are considered naked if any part of their body is showing except for their face and hands, while a man is considered naked only between his navel and his knees. Finally, although Muslim men may marry Christian or Jewish women, Muslim women may only marry Muslim men.

Segregation, in short, is central to sharia -- a fact that no amount of contortion by self-styled Muslim feminists can get around.

True, not all Muslim-majority countries apply sharia. In Tunisia, after a heated internal debate, the Islamist Ennahda Movement -- which came to power following the Arab Spring -- opted last year not to make sharia the basis for the country's new constitution. But that is precisely the kind of moderate policy explicitly targeted by whichever jihadist gang carried out the Tunis museum massacre. And the troubling thing is that, worldwide, sharia is gaining ground. In Brunei, for example, the Sultan announced the introduction of sharia law last April. The advance of organizations like Islamic State and Boko Haram mean the most brutal application of sharia on a rising number of women and girls.

There seems to me only one possible way to react to this trend toward sharia and that is to resist it. Perhaps that is more obvious to me than to most; having lived under sharia when I was a young girl in Saudi Arabia I know just what it means to be a second-class citizen. Yet many Western liberals seem to struggle with the obvious point that if they were against segregation and discrimination in the 1960s they should be against gender segregation and discrimination now....

ADEN, Yemen (AP) — A group claiming to be a Yemeni branch of the Islamic State group says it carried out a string of suicide bombings in the Yemeni capital, Sanaa, that killed a total of 137 people and injured 345 others. 

The group posted an online statement saying that five suicide bombers carried out what it described as a "blessed operation" against the "dens of the Shiites." 

The bombers attacked the Badr and al-Hashoosh mosques, located across town from each other, during midday Friday prayers. 

The claim, posted in an online statement, could not immediately be independently confirmed and offered no proof of an IS role. It was posted on the same website in which the Islamic State affiliate in Libya claimed responsibility for Wednesday's deadly attack on a museum in Tunisia.

More than 120 people died and hundreds were injured as four suicide bombers attacked two mosques in Yemen’s capital city. 

So many people were killed or injured that hospitals in Sanaa struggled to cope with the emergency and public pleas were made for blood donors to come forward. 

Many of the worshippers in the mosques were supporters of the Shia Houthi fighters who control the capital, and responsibility for the carnage was claimed by Isis which regards all Shia as heretics – though it was impossible to immediately verify this and some analysts were sceptical. 

The final death toll was uncertain last night, with sources giving varying accounts, at least one putting it at 137 with a further 350 people injured. But the authorities warned that with so many of the wounded suffering critical injuries the toll is sure to rise. 

After the blasts the wounded were loaded on the back of pick-up trucks and were taken to hospitals where, as they waited for treatment, they lay side by side with the dead. 

Among the dead was, according to Al Jazeera and Houthi-owned television, the imam of the Badr mosque, the prominent Houthi cleric al-Murtada bin Zayd al-Mahatwari. 

Two senior Houthi leaders, both members of the Zaidi Shia sect and named as Taha al-Mutawakkil and Khalid Madani, were reported to have been seriously wounded. 

“Dozens of people have been injured or killed. We will understand the exact numbers of [the] dead and wounded soon. These are two very central and commonly used mosques,” the editor-in-chief of the Yemen Post newspaper, Hakim Almasmari, told reporters.

Suspected Boko Haram bombers killed at least 54 people and wounded 143 in a series of bloody suicide attacks Saturday in Maiduguri, Nigeria. 

The blasts occurred over four hours in locations from a busy fish market to a crowded bus station in the city, which is located in the northeast region of the country, Police Commissioner Element Adoda said. 

Witnesses reported scenes of gore with mangled bodies and injured victims lying on the ground. Maiduguri is the birthplace of the Islamic extremist group. The Nigerian military drove Boko Haram out of the city last year. 

The deadliest blast occurred at the bustling Baga fish market, where at least 18 people were killed after a suicide bomber blew himself up in a rickshaw taxi near the entrance. 

“I saw many dead bodies lying on the ground, many dead, and several others badly injured,” fish seller Idi Idrisa said.

Some experts say that the pledge, or “bayat,” made by the leader of Boko Haram is a spiritually binding oath, which indicates that the Nigerian Islamist group has agreed to accept the authority of the Islamic State. 

But as with similar pledges to the Islamic State, also known as ISIS or ISIL, by other extremist groups, there are few details about how much direct control the Islamic State leaders have over their distant proxies. 

If confirmed, the agreement with Boko Haram would mirror the steps taken by Islamic State affiliates in Libya, Algeria, Egypt, Afghanistan and beyond. 

In each case, a group’s leaders swore allegiance in a public message posted online. Weeks later, the oath was formally accepted by the Islamic State, in a statement issued by the group’s spokesman. 

“It’s quite clear that since at least mid-January, the Islamic State has had some level of connection with Boko Haram,” said Aaron Y. Zelin, a fellow at the Washington Institute who tracks propaganda by Islamic extremists. 

“The key question is whether the Islamic State dispatched individuals from Syria or Iraq, or else from Libya, down to northern Nigeria to help out with operations on the ground, or else with methodology, or in terms of governance activities.” 

Boko Haram has an estimated 6,000 fighters and at least some level of control over approximately 20,000 square kilometers of northeastern Nigeria, according to Ryan Cummings, chief Africa analyst for red24, a crisis management group based in Britain, who has been following the group since 2011.

But as the Daily Beast notes the price will be steep. “The bargain for making a deal with Iran, these critics say, has allowed Iran a free hand to assert dominance in Iraq, Syria, Lebanon and Yemen.” Having spent years campaigning against American military action Obama has essentially left himself no other choice but to rely on  someone else.  ”Such an approach is also politically unfeasible due to American war weariness and scepticism of any mission with shifting goalposts.

And Iran is charging him an arm and a leg for yanking him out of the hole.  Yemen, next-door-neighbor to Saudi Arabia has now been partitioned between an Iranian client state which has as its capital Sana’a — from which the GCC embassies have evacuated — and Aden, to which they will be moving as the new capital of Sunni recognized Yemen.

Obama’s own efforts to establish “moderate rebel” forces in the region have ended in ignominious defeat, having accomplished nothing but showcase his pitiful incompetence. One of the main Obama-backed groups has just folded up and joined the enemy.

Hazzm is one of the last remnants of non-jihadist opposition to President Bashar al-Assad in northern Syria, much of which has been seized by the Nusra Front and Islamic State, an offshoot of al Qaeda that controls roughly a third of Syria.

All hope of independent action is fading fast. Micah Zenko at Foreign Policy is calling the debacle Obama’s Bay of Pigs in the Desert. The Obama administration has effectively destroyed its own credibility, by the ample display of stupidity, possibly past the point of recovery. As a Brookings Institution article puts it “If America leads, will anyone follow?”

even if the United States is still willing and able to lead, and even if other major powers accept that it does so, Washington will likely confront the growing problem of followership. President Obama made clear in his 2014 West Point speech that future interventions by the United States in overseas conflicts will be a function of the willingness of “partners” to lend a hand. In fact, Washington has always depended to some extent on other nations to supplement its efforts, but the question for the future is whether this operating principle remains feasible.

Hundreds of people are watching a YouTube video of a London professor interrupting a university conference on immigration to protest against the presence of “an Islamist who supports stoning to death and sharia law“. 

Professor Reza Moradi interrupted a talk organised by the University and College Union (UCU) held at the London Metropolitan University, to criticise the decision to invite Mohammed Kozbar, vice president of the Muslim Association of Britain (MAB), to take part in the discussion panel. 

“MAB is what is known as a ‘soft’ Islamist organisation, normalising and justifying terrorism, the Caliphate and sharia rules,” Moradi wrote on his Facebook page after the incident.

Australia: Terrorists threaten Senator Jacquie Lambie with beheading unless she helps introduce sharia law

POLICE are investigating a poison pen letter claiming that terrorists plan to behead Tasmanian Senator Jacquie Lambie unless she helps introduce sharia law in Australia. 

The letter warns that “you are the enemy of Islamic State, therefore, I will take the honour in beheading you”. 

It includes graphic images of a man having his head sliced off by a knife. 

Her office conceded the letter could be a fake threat, linked to opponents of a new mosque in Adelaide, but said that they were taking the threat seriously and had referred the matter to the Australian Federal Police. 

It claims to have been prepared by the “Adelaide Islamic State Mujahideen” and makes references to plans to build a mosque in Adelaide, suggesting that the development would represent a celebration of Lindt gunman Haron Monis’s efforts to expand the Islamic State’s philosophy.

Is President Obama a Muslim? A lot has been written about this, but if photographs speak louder than words, then a photo taken at last August’s U.S.-African Leaders’ Summit in Washington D.C. might shed considerable light. It shows Barack Hussein Obama flashing the one-finger affirmation of Islamic faith to dozens of African delegates.

The Associated Press took this astonishing photo as the African dignitaries joined Obama, who hosted the event, in a State Department auditorium for a group photograph. It was published in an article in Britain’s Daily Mail, and it was the only use ever of the photo. 

The one-finger display is the distinctive Muslim gang sign: The index finger points straight up while the thumb wraps underneath and presses against the digital phalange of the middle finger. The remaining fingers are squeezed against the palm in order to highlight the extended forefinger. The extended finger is symbolic of the one-God concept of Muhammad and is understood by all believers to be a symbolic shahada, the Muslim affirmation of faith: There is but one God and Muhammad is his messenger.

Thus when believers stick their index finger in the air, they demonstrate they are partisans of Muhammad’s God concept. And they also affirm their belief in Muhammad’s claim he was the interface between God and man. They also demonstrate they are part of the umma, the exclusive transtribal supertribe of believers that Muhammad started 1,400 years ago. 

With his forefinger in the air, Obama affirmed his membership in this tribe.

The Daily Mail editors did not understand what they were looking at. They captioned it “finger wagging” by Obama. But the African dignitaries understood, and a range of reactions can be detected among the ones who observed the gesture: amusement, surprise, curiosity, disapproval, contempt. 

Note the reactions of Abdelilah Berkirane, the prime minister of Morroco pictured just behind Obama’s left shoulder, and Ibrahim Boubacas Keita, the president of Mali in white garb and hat. They are Muslims through and through, and they are all smiles. They knew what Obama’s upright forefinger meant.

The reaction of Togo president Faure Gnassingbe, at the top row second to the left, is less approving. Through his face you can read the mind of this Sorbonne- and George Washington University educated leader. His mind is screaming, “You gotta be kidding!”

Gnassingbe’s country is squeezed between Benin and the Ivory Coast and is not far from Nigeria and its Boko Haram plague -- perhaps a two-hour flight in a slow Cessna from Togo’s capital to the Nigerian capital, less than an hour in something faster. At the time of the Washington conference, Boko Haram’s leader Abubakar Shekau had just declared Borno State in northeastern Nigeria as the seat of his caliphate. Massacres of entire villages were taking place; only a few months earlier nearly three hundred girls were abducted from a Borno secondary school. 

Togo has seven million people, 50 percent animists, 30 percent Christian. The remainder are Muslims, part of the umma. Gnassingbe and all other non-Muslims of Togo have reason to worry about radicalization of some of these members of the transtribal supertribe of Muhammad who reside among them. And so his look of disdain. “You gotta be kidding.”

Transcripts of telephone intercepts published in Italy claim to provide evidence that ISIS is threatening to send 500,000 migrants simultaneously out to sea in hundreds of boats in a ‘psychological weapon’ against Europe if there is military intervention against them in Libya. 

Many would be at risk of drowning with rescue services unable to cope. But authorities fear that if numbers on this scale arrived, European cities could witness riots. 

Separately, the militants hope to cement their control of Libya then cross the Mediterranean disguised as refugees, according to letters seen by Quilliam the anti-terror group, reported by the Telegraph.

“[O]ne of the great about America is it doesn’t matter if you’ve been here five minutes or a hundred years, we have folks that come here, want to be Americans,” Jindal said. “They join our military, they start companies, they work to create a better community. And that’s wonderful." 

"What’s not acceptable is people that want to come and conquer us."

"That’s not immigration, by the way, that’s colonization."

"If someone wants to come here and change our fundamental culture and our values. If they want to come here and they want to set up their own culture and values that’s not immigration, that’s really invasion — if you’re honest about it." 

"Of course, the politically correct crowd when you say things like they’ll call you racist — but this is a particular threat we face. And if we’re not serious about this we’re going to see more lone wolf actors. We’re going to see more folks come into our country just like you’ve seen in other countries — the horrific shootings in Paris.”

The reason Jindal gets it is because his parents are Hindu immigrants from India. Indian Hindus have likely suffered worse atrocities at the hands of Muslims than any other single group of people on the face of the Earth, with the exception of the Christians who used to dominate the Middle East.
