CAIR Helps Define Jihad

Late last week, Federal Judge Colleen Kollar-Kotelly, sitting in the United States District Court for the District of Columbia, denied the Council on American-Islamic Relation’s (CAIR) motion for partial summary judgment in a lawsuit CAIR filed against the Center for Security Policy (CSP) and several of its employees, thereby setting the stage for the case to go to a jury trial.

CAIR, which bills itself as “America’s largest Muslim civil liberties and advocacy organization,” sued CSP – a national security policy think tank – and its employees for working on a documentary designed to expose CAIR’s Muslim Brotherhood-Hamas ties and other illegal activities.

While dealing a blow to CAIR, the court granted most of CSP’s motion for summary judgment, sending a few of the surviving issues to trial on the presentation of the slimmest of evidence by CAIR.  Based on this “evidence,” the court concluded that there were factual disputes that had to be resolved by a jury.

With regard to six of the claims advanced by CAIR, the court had these harsh words to say:

The Court finds that Plaintiffs [i.e., CAIR] have thus far been frustratingly unclear as to the injuries at issue for each of the claims.  In addition, Plaintiffs have not specified which injury, if any, corresponds to which of the Plaintiffs, and have made little effort to explain the proximate cause linking the alleged tortious conduct to the injuries at issue.  Instead, Plaintiffs speak in broad generalizations, asserting injuries and damages and proximate cause across multiple counts and multiple Plaintiffs.  As a result, the Court has received only opaque and largely unhelpful briefing. . . .  Plaintiffs are not specific as to these issues, making resolution of the threshold questions of injury and proximate cause next to impossible for the Court.

Robert Muise, Co-Founder and Senior Counsel of the American Freedom Law Center (AFLC), which is representing CSP and its employees, commented:

“While we believe that the court incorrectly went to great lengths to find scant ‘evidence’ to conclude that there are material issues of fact to be resolved by a jury, CAIR is nonetheless in trouble not only with its few surviving claims, but also with the possibility of a public trial that will most certainly expose CAIR for what it is – a sharia-ist front group.”

AFLC is planning to file a motion for reconsideration, arguing that the court misconstrued both the law and the facts with regard to the few surviving claims.

David Yerushalmi, AFLC Co-Founder and Senior Counsel, commented:

“We are certainly disappointed that the court did not rule entirely in favor of our clients, especially because CAIR manifestly abused the legal process in this litigation and because the facts uncovered clearly demonstrate that the documentary was undertaken legally and quite properly.  However, we are eager to prove in court what the documentary sought to prove in the public square: that CAIR is a Muslim Brotherhood-Hamas front group.”

In 2008, Dave Gaubatz, an experienced federal investigator, was hired as an independent contractor to put together a team of field researchers to assist in the documentary.  As part of the field research, Dave Gaubatz trained his son, Chris Gaubatz, to work undercover as an intern with CAIR, which required Chris to wear an audio-video recorder on his clothing to obtain recordings of the routine activities of a CAIR intern.  During this internship, it became clear that both a major fraud occurred within the organization and that CAIR officials were attempting to cover it up.  (AFLC represents five former CAIR victims in a federal lawsuit in the same court alleging fraud and a cover-up by CAIR.  AFLC has filed a motion for summary judgment in that lawsuit as well and is expecting a ruling from the court very soon.)

After the field research for the documentary was completed, Dave Gaubatz published a book entitled,Muslim Mafia: Inside the Secret Underworld that’s Conspiring to Islamize America, which was an exposé on CAIR.  Shortly after the book was published, CAIR filed a lawsuit in federal court in Washington, D.C., against Dave and Chris Gaubatz.  CAIR then amended its lawsuit to add CSP and several of its employees who were involved in the production of the documentary.  CAIR’s lawsuit alleges violations of various federal wiretap and hacking statutes as well as several common law torts, such as breach of fiduciary duty and trespass, among others.

The case has been ongoing for nearly four years.  At various times throughout the litigation, the court criticized CAIR and its in-house legal counsel for their inability to both efficiently manage the case and to comply with court procedures.  Furthermore, the court scolded CAIR’s in-house lawyers for filing untimely and substantively deficient motions.

CAIR, a self-described Muslim public interest law firm, was previously named as an unindicted co-conspirator and Muslim Brotherhood-Hamas front group by the FBI and the U.S. Attorney’s Office in the successful prosecution of a terrorist funding cell organized around one of the largest Muslim charities, the Holy Land Foundation (HLF).  HLF raised funds for violent jihad on behalf of Hamas, and top CAIR officials were part of the conspiracy.  As a result, the FBI publicly terminated its outreach activities with CAIR.

Recent Court Ruling: "anonymity does not mean immunity under defamation law"

“I think the court is sending a strong message to those who abuse the internet by defaming others and think they can get away with it by acting anonymously,” he told KYWnewsradio.

“The court is strongly saying that anonymity does not mean immunity under defamation law.”

Podraza says the ruling should provide protection from defamation for all citizens.

Think of the range of possibilities.

The word citizens could be interpreted in a global fashion and could include the idea that insulting someone is defamation per se.

After all, we live in an Orwellian World.

The Federal Communications Commission is planning a broad probe of political speech across media platforms, an unprecedented move that raises serious First Amendment concerns.

The FCC’s proposed “Multi-Market Study of Critical Information Needs,” which is set to begin a field test in a single market with an eye toward a comprehensive study in 2014, would collect a remarkably wide range of information on demographics, point of view, news topic selection, management style and other factors in news organizations both in and out of the FCC’s traditional purview.

The airwaves regulator would also subject news producers in all media to invasive questioning about their work and content.

Among the questions federal contractors will be asking of private media companies:

For media owners:

“What is the news philosophy of the station?”

For editors, producers and managers:

“Have you ever suggested coverage of what you consider a story with critical information for your customers (viewers, listeners, readers) that was rejected by management?” (Followup questions ask the reporter to speculate on why a particular story was spiked.)

“In this study, the FCC will delve into the editorial discretion of newspapers, web sites and radio and TV stations,” Hudson Institute Fellow Robert McDowell, who served as an FCC commissioner from 2009 to 2013, told The Daily Caller. “This starts sticking the government’s nose into what has traditionally been privileged and protected ground. Amazon Secretly Removes “1984” From the Kindle

Thousands of people last week discovered that Amazon had quietly removed electronic copies of George Orwell's 1984 from their Kindle e-book readers. In the process, Amazon revealed how easy censorship will be in the Kindle age.

In this case, the mass e-book removals were motivated by copyright . A company called MobileReference, who did not own the copyrights to the books 1984 and Animal Farm, uploaded both books to the Kindle store and started selling them. When the rights owner heard about this, they contacted Amazon and asked that the e-books be removed. And Amazon decided to erase them not just from the store, but from all the Kindles where they'd been downloaded. Amazon operators used the Kindle wireless network, called WhisperNet, to quietly delete the books from people's devices and refund them the money they'd paid.

Regardless of whether you believe Amazon's promise to leave your Kindle alone, the company has tipped its hand and shown us the dark side of a culture where books are only available in electronic form. If the WhisperNet service from Kindle allows the company to delete books silently from your device, what other information might they have access to? Can the company monitor what you're reading and when - and then hand that over to law enforcement? Can it replace a book file with a different file whose content is changed?

Perhaps more than anything else, this mass deletion of 1984 has made it clear that collecting e-books is going to require some technical know-how. No e-book is truly yours unless you can get it off your Kindle and onto your computer - hopefully a computer that isn't connected to the internet

In its latest effort to protect followers of Islam in the U.S. the Obama Justice Department warns against using social media to spread information considered inflammatory against Muslims, threatening that it could constitute a violation of civil rights....

The DOJ political appointee adds in the article that the upcoming presentation will also focus on Muslim culture with a special emphasis on the fact that the religion is no different from others, even though some in the faith have committed terrorist acts, Christians have done the same....

Jihad Watch Wins CPAC Award, Barred From Receiving It

I was surprised and honored that Jihad Watch was among the nominees for the People's Choice Blog Award, sponsored by Right Wing News and TheTeaParty.net, to be awarded at the Conservative Political Action Conference (CPAC) 2013.

... Jihad Watch won decisively, getting over 50% of the vote in a field of fifteen....

But as time went by and no announcement was made of this victory, and the voting continued despite my having been told that it officially ended last Friday night and that I had won, and the promised links and other placement promised to the winning blog didn't materialize, I started to wonder. So I contacted the organizer who had written me telling me I won and asked him what was going on.

He told me that there was a slight problem: the Tea Party group, which co-sponsored this People's Choice Blog Award, didn't want to allow me to receive it at CPAC next week unless I promised not to criticize Grover Norquist and Suhail Khan as I accepted the award.

I told the organizer that I couldn't agree to that. He asked me if I had planned to talk about Grover and Suhail. I said no, I hadn't, but I had to now.

So that's that. The People's Choice Blog Award is now the Grover's Choice Blog Award. I will not be going to CPAC and will not be receiving this award.

And since I will not be allowed to receive this award at CPAC, I will talk about Norquist and Khan here....

I really don't have all that much to report, but I wanted to let you know I'm working on it. The situation is very much the same: the comments feature is still not working, it is still very difficult to post articles at all, and other features of the site are non-functional..

Several tech experts are working on the problem. Some malicious code has been found, which makes it likely that the site was hacked, although this hacking was not a conventional one: no eradication of the main page and its replacement by a taunting message, as is the usual practice. In fact, the malicious code is apparently (if I understand the explanation correctly, which is chancy at best, since I'm no techie) slow-acting, unfolding over time. We are looking into how it got there, and who planted it.

In any case, all I can say now is that we're working on it and will have the site fully operational as soon as possible. This kind of action just shows yet again how desperately insecure and thuggish the enemies of freedom are -- they can't refute us, so they try to shut us down. And how many Leftist and Islamic supremacist sites do you ever hear about getting hacked?

This time, the OIC is horrified by the latest Charles Hebdo comic book mocking MTP.  From Arab News:

The Organization of Islamic Cooperation (OIC) has slammed caricatures of the Prophet (peace be upon him), published in the French satirical magazine Charlie Hebdo, saying it incites hatred and intolerance against Muslims.

OIC Secretary-General Ekmeleddin Ihsanoglu expressed concern at the publication of the comic book series on the life of Prophet Muhammad (pbuh).

Ihsanoglu said the publication went against the norms of responsible journalism and was tantamount to abuse of the right to freedom of expression. He added that incitement and advocacy of hatred and intolerance on religious grounds signified by this publication was in contravention of international human rights laws and instruments.

He called on the magazine to abide by the provisions, particularly those in the European Union (EU) context, on incitement to hatred and violence. He urged the authorities in France to take appropriate action against the magazine....

She wrote: “I want to own up to and explain that earlier today I sent out two tweets about saying prayers for the people in Palestine and Israel and after hearing from my followers, I decided to take down the tweets because I realised that some people were offended and hurt by what I said, and for that I apologize.”

She added: “I should have pointed out my intentions behind these tweets when I posted them.

“The fact is that regardless of religion and political beliefs, there are countless innocent people involved who didn’t choose this, and I pray for all of them and also for a resolution.

“I also pray for all the other people around the world who are caught in similar crossfires.”

So, the Islamic freaks win again.

Interior Minister Of Pakistan Steals Obama's Thunder

He takes credit for the arrest of the filmmaker of Innocence of Muslims. Malik said:

“I don’t claim entire credit, but it is a credit for the Muslim Ummah, the credit goes to my government. In fact, it is our government and the entire world which took up this derogatory documentary film at all international forums,” Malik told a news conference at Pakistan’s Embassy in Washington on Saturday.

When pressed on the point that Nakoula had been arrested for violating terms of his bail in a separate case, Malik said, “I pointed out that he is a fugitive of law, I did have information. And perhaps that voice reached the right quarters, and he was arrested, it is not me who has made the arrest, but I became instrumental in appealing to the United States.”

About his meeting with US Secretary of State Hillary Clinton at the State Department, Malik said he thanked Clinton and President Barack Obama for condemning the anti-Islam film.
